Terms and Conditions
Please remember a reservation is a legal contract. We strongly recommend you ensure you are adequately covered by insurance for your rental.
When a booking is made more than 6 weeks before the tenancy is due to commence, a deposit of £100 must be paid to confirm the booking. If a booking is made 6 weeks or less before the tenancy is due to commence, the full rent must be paid at the time the booking is made.
2. Balance of Rental
Once a booking has been accepted, tenants must pay the balance of rental four weeks before the tenancy commences. If the balance has not been paid by this time we reserve the right to cancel the booking.
3. Arrival and Departure Times For 2012
SATURDAY to SATURDAY: Arrival is welcomed after 3.00pm and departure requested by 10am.
4. Damage and Cleaning Deposit
Please tidy and clean the property before departure. Cleaning materials are provided so that guests can leave the cottage as clean as they find it.
We require a £100 refundable deposit to be paid with the balance of rental payment to cover damage and cleaning of the property if it is left in an untidy or dirty condition. The deposit will be refunded immediately after your stay, provided that the property is clean and tidy and there has been no significant damage.
5. Bedlinen and Towels
Tenants should bring their own bed linen and towels unless prior arrangements are made for us to supply (Bed linen and towels can be hired and, where supplied, linen is changed between tenancies, and weekly during tenancies of more than a week). A fee of £10/person/week will be applied where linen/ towels are requested. Tenants are requested to bring their own beach towels.
Tostarie caters for pets but they must be kept under control at all times and we accept no responsibility for their safety. They should not be allowed in the bedrooms or on the furniture, or be left unsupervised in the property due to the risk of damage. Tenants are responsible for cleaning up any fouling which their pets may cause around the property.
Tostarie House is a NON SMOKING establishment.
8. Authority to Sign
The person completing the booking certifies that:
• He/she is authorised to agree the booking conditions on behalf of all persons included on the booking form, including those who may be added/substituted at a later date. He/she is over 18 years of age and is a member of the party intending to occupy the property.
• He/she agrees to take responsibility for the party occupying the property.
9. The Tenancy Agreement
A maximum of four adults and two children to stay at the property unless prior agreement obtained from the owners
The tenancy gives the Tenants the right to occupy the property for a holiday within the meaning of Schedule 1 paragraph 9 of the Housing (Scotland) Act 1988. Tostarie is let for a maximum of 4 weeks. Lettings commence at 3pm on the first day of the tenancy and end at 10am on the departure date unless otherwise agreed. Tenants will be liable for any cost whatsoever incurred as a result of an un-authorised extension.
10. The Tenants’ Obligations
- a To pay for any losses or damage to the property caused by the Tenants or a member of their party (reasonable wear and tear excluded).
- b To take good care of the property and leave it in a clean and tidy condition at the end of the tenancy. No cleaning service is provided during the tenancy unless specifically stated but this can sometimes be arranged.
- c To allow the Owners reasonable access to the property.
- d To not exceed the total number of people as stipulated in the description of the property.
- e Not to cause undue noise or disruption or become a nuisance to occupants of any adjoining premises.
In the event of a cancellation we are unable to return your deposit but if we manage to re-let the cottage we will return any balance already paid. We strongly advise that guests take out holiday insurance.
All cancellations must be notified to ourselves before the holiday commences, ideally by telephone but in any case in writing within 7 days of the event that gives rise to the cancellation. While every effort will be made to re-let a cancellation it is important to remember that if a substitute Tenant cannot be found, the Tenant remains responsible for the period of the reserved tenancy, plus the cost of any additional advertising which may be necessary. If cancellation occurs within one calendar month of the letting, we will make best efforts to re-let, but if we are unable to do so, we will be unable to return either the deposit or the rental fee.
12. Non-availability of Property
If for any reason beyond our control, the property is unavailable on the day when the tenancy is due to begin (e.g. due to flooding, fire damage etc.) or the property becomes unsuitable for holiday letting, Tenants will receive a full refund of all rents and charges already paid. We will make every effort to find a suitable alternative property but the Tenants shall have no further claim against the Owners.
The Owners accept no liability for loss or damage to the Tenants possessions on the Owners land or property. Neither do the Owners accept any liability for personal accident or injury on the Owners land or property.
14. Breach of Contract
If Tenants breach any of the above terms and conditions, the Owners reserve the right to re-enter the property and terminate the tenancy, without prejudice to the other rights and remedies of the owners.
15. Validity Clause
If any term or provision in these Booking Conditions shall in whole or in part be held to any extent to be illegal or unenforceable under any enactment or rule of law, that term or provisions or part shall, to that extent, be deemed not to form part of this agreement and the enforceability of the remainder of this agreement shall not be affected.
